Sepa approves the Malir Expressway’s controversial EIA

SEPA has given the go-ahead to the controversial Malir Expressway project, which has been under construction for more than a year, without taking into account the real concerns of local residents and experts about the environmental impact assessment (EIA) report, it was revealed on Sunday. The project is already worth billions of dollars.

Environmentalists and people who live near the project say that Sepa’s approval of an EIA mock the Sindh Environmental Protection Act 2014. Section 17 (1) says that “No project shall be built or operated until an IEE [initial environmental examination] or EIA has been submitted to and approved by the Agency.”

According to sources, work on the project started soon after it was opened by Pakistan People’s Party leader Bilawal Bhutto-Zardari in December 2020. So far, earthwork on the 15-mile-long section from Jam Sadiq Bridge to Quaidabad has been done.

The project will connect the city’s affluent areas with the newer gated communities that are forming on the city’s outskirts. It was made possible by a public-private partnership.

A 38.75-mile 3×3-lane expressway with controlled access will be built along the Malir river. It will start at the Korangi Creek Avenue (DHA) and end at the Karachi-Hyderabad Motorway (M-9) near Kathore through the existing Link Road.

The document had a lot of problems with the EIA report, but two of them were about groundwater resources and ecological assets that were wrong.

According to the document, the report doesn’t include information about the project’s impact on the local population, information about heritage sites, or information about other ways to achieve the project’s stated goals with the least environmental and social impact.

210 permanent homes with 1,500 people and 49 temporary structures would be demolished for the project, while 6,635 acres of private land would be bought.

According to the sources, Sepa did not respond to these concerns, which is another violation of its own law.

Environmental impact assessments and strategic impact assessments must be carefully reviewed by the Agency, and any decisions or actions taken on them must be communicated to the people who made them. This is what Section 3 of Section 31 of the Act says.

There are a lot of things the proponent must do before we give them the go-ahead. The head of Sepa said that his department will keep an eye on the work and yank the approval if there are any violations.

It wasn’t going to flood because it was built on the bank of the Malir river, he said. “It will, in fact, make its embankments stronger.”

It was a good idea for the director general to say that “people who truly represent the communities should be on board with these developments.”

The DG did not sign off on the EIA.

Asked why the project’s approval was signed by the deputy director instead of him, he said the whole process was under his control and there was nothing wrong with this.

Zubair Ahmed Abro, a senior lawyer who specialises in environmental law, disagreed with this. He said that the director general would need to sign off on the project.

In this case, he talked about an order from an environmental tribunal in the Seaview commercialization case.

Court rules that approval is an appealable order and must be signed by the director general himself, he said. The deputy director’s signature on the approval was against the law.

It’s also a law that requires the environmental watchdog, Mr. Abro said, to set up advisory committees with people from different sectors who can look over EIAs.

The fact that these committees kept not meeting, he said, was a violation of the law Sepa was supposed to follow.

“The Supreme Court has said that the provincial government must set up advisory committees under the environmental law, and not setting them up would be a breach of a statutory duty and make an EIA invalid,” he said.

This is not the first time that Sepa has approved an under-construction project, but it needs a professional review of the whole process in order to make the whole thing seem real.

This is what happened in 2020: The CDA approved PC-1 worth Rs8.21 billion for the sector’s development. This money will be used for everything from complete infrastructure development to electrical and mechanical work and amenities, and other services. People in charge of this project said that by 2023, the sector was supposed to be fully grown and ready.

The I-12 sector has been around for a long time and has more than 6,000 acres. However, no real effort was made to grow the sector. Also, the undeveloped area has been used to dump things for many years.

People from the CDA said they were trying to move the temporary landfill site to a new place, and they were looking at different locations for that.

They said that last year, the CDA had planned to put the landfill site in H-16, but people living nearby and a court case meant that the landfill site couldn’t be moved there. However, they said that H-16 was only for institutions and not for people to live in. So, the CDA will ask the court to let them use it as a temporary landfill site. A long-term solution was being worked on by the CDA and the Rawalpindi Development Authority (RDA). They were working together to set up a scientific landfill site in Mandra.

On the other hand, sources say that the CDA also signed a contract worth Rs980 million on Tuesday to install an Intelligence Transportation System (ITS) and a Command and Control System for the Peshawar Mor IIA metro service.

They could not be sent to Pakistan because of the Covid-19 cases in Shanghai. They are now expected to arrive in Karachi on May 5, though. However, the CDA set up 15 buses from the Rawalpindi-Islamabad Metro Bus Service as a stop-gap measure.

As soon as the new prime minister took office, he ensured the CDA took steps to start a service in five days.

Appointment of Evacuee Trust Property Board chief contested in IHC. This decision about who should be in charge of Evacuee Trust Property Board (ETPB) has been made in Islamabad High Court (IHC).

The vice-chancellor of Iqra University, Dr. Mohammad Ali, filed a complaint about the appointment of Habibur Rehman Gillani as chairman of the ETPB. He said that the work was made “mysteriously” during a “vacuum” caused by the recent constitutional crisis. Mohsin Akhtar Kayani, an IHC judge, heard the petition.

It says that on December 12, 2021, the Ministry of Religious Affairs put up an ad for the job of ETPB’s chairman.

As many as 41 people applied for the job, including the petitioner. On February 22, 2022, the selection board for the job chose 20 people who were invited for interviews on March 10, 2022.

The petition said that the board made a summary for the cabinet that included the names of Gillani, the petitioner, and Mr Mehmood.

The lawyer for the petitioner, advocate Hashmat Ali Habib, told the court that the summary was never approved because it was never on the agenda of the cabinet meetings until Imran Khan was ousted. This can be seen in the Cabinet Division meeting on April 9, 2022.

Mr Gillani was named chairman of the ETPB on April 11. The petition called this a “surprise.” The petition said that the notification was against the law because the prime minister was no longer in charge of the country from April 3 to April 9. A week before April 10, the office of the Prime Minister was empty.

The notification sent out did not follow the law and procedure set out in the Evacuee Trust Property Board’s Chairman (Appointment and other Terms and Conditions of Service) Rules 2019, which were made in 2019.

It was said that the appointment of Mr Gillani was made by the Ministry of Religious Affairs when the federal cabinet was dissolved.

Another thing to note is that there are no cabinet meeting minutes or an agenda notification about how the decision was made.

It sent a letter to the religious affairs ministry secretary and asked for an answer by May 12.
