PHC investigates into hotel construction on forest land

PHC investigates hotel building on ‘forest land.’ On Thursday, the Peshawar High Court asked the Abbottabad district administration to investigate the alleged encroachment of Ayubia National Park forest land for the construction of a five-star multi-story hotel in the Nathiagali tourism region.

While hearing various environmental petitions, a bench comprising Chief Justice Qaiser Rashid Khan and Justice Syed Arshad Ali took note of the situation.

The bench asked additional deputy commissioner Mohammad Shahab to inspect the premises, conduct an investigation, and submit a report to the court.

It noted that during one of the hearings, the director-general of Galiyat Development Authority testified and disputed the allegation of forest land encroachment, implying that if the claim is determined to be untrue, it will take action against the DG.

Senior advocate from Hazara division Sardar Nasir Aslam informed the bench that the ongoing building of the five-star hotel breached the norms.

He pointed out that around six kanals of Ayubia National Park forest land had been incorporated in the area allocated to the relevant firm for the hotel, which was against the law.

The bench, known as the green bench, took up numerous environment-related petitions filed by lawyers for consideration.

The court has already ordered the demolition of encroachments alongside the Swat, Kunhar, and Chitral rivers during prior hearings.

Numerous administrative personnel was called to testify before the bench: Malakand division commissioner Zaheerul Islam, Swat deputy commissioner Junaid Khan, and Abbottabad ADC Mohammad Shahab. Shumail Ahmad Butt, the advocate general, and Syed Sikandar Hayat Shah, the additional advocate general, also appeared.

According to Zaheerul Islam, the administration has already demolished 68 hotels for being erected unlawfully on the riverbed in response to the court’s ruling.

He added that all leases for sand mining from the river had been annulled and had obtained no new licenses.

An assistant commissioner informed the court in Hazara that the administration had demolished approximately 160 large structures and 6,000 tiny ones along the region’s rivers.

Advocate Babar Khan Yousafzai attended on behalf of several investors and stated that his clients had invested considerably in the Samandar Katha Lake project near Nathiagali following a valid government contract win. But, still, it destroyed the project on the high court’s orders. Therefore, he sought redress on behalf of the petitioners.

Bid cleared for Rs191b Sukkur-Hyderabad motorway

Bid cleared for Rs191b Sukkur-Hyderabad road. The Public-Private Partnership Authority has accepted the bid documents for the prestigious Sukkur-Hyderabad Motorway project.

According to a statement released on Friday, the project, accepted to be built through a Public-Private Partnership (PPP), will cost around Rs191 billion ($ 1.23 billion).

Asad Umar, the Minister of Planning, Development, and Special Initiatives presided over the board meeting. Following the board’s approval of the bid materials, the project will be floated in the market, with bidders given ample time to develop their proposals.

Previously, the board approved a commercial feasibility study and restructured the project’s transaction structure. As a result, the project will construct a 306-kilometer greenfield six-lane access-controlled toll road on a Build-Operate-Transfer (BOT) basis.

Following the financial close, the project is projected to be finished in 30 months. The project has a 25-year concession duration.

Bidders reject criteria for railroad freight operations outsourcing. Most bidders have characterized the Pakistan Railways’ bidding process for outsourcing commercial functions of freight trains as unfair (PR).

Rejecting the evaluation process, bidders have urged the public relations (PR) authorities to review the facts thoroughly, bidding documents, rates, and requests for proposal (RFP) and ensure that projects are awarded to qualified firms based on merit.

“Ten of the thirteen bidders have rejected the evaluation criteria for the bidding process, which began in February and concluded in August. Thus, after nearly six months, the typical bureaucratic and anti-private sector culture and favoritism within the PR, which are also responsible for its demise, finally worked,” an official source lamented in an interview on Friday. According to the letter written by one of the firms to the chairman of the PR’s Grievance Committee, the firm developed a detailed plan and submitted its bid “to ensure the highest yield per wagon per annum” following the RFP document’s requirements.

“However, to our surprise, we received a letter from the chief marketing manager’s office on Aug 31 notifying us of the rejection of our ‘financial bid’ because our offered bid rates were lower than the PR’s previously notified rates for the destinations for which we submitted our bid,” the letter reads.

It deemed the reason unjustified, claiming that the railways did not include a complete schedule of existing notified rates for all destinations in the RFP, nor did they have any instructions directing all interested parties to use any benchmark rates as a reserve price’ when submitting bids. On the contrary, the RFP’s instructions and, more precisely, the Financial Proposal Submission Form Multiple Train Options’ Note stated unequivocally that “the bid would be evaluated based on the highest yield per wagon per year subject to the loading and unloading yards’ maximum capacity.” Moreover, there was no mention of the tariff in the minutes of the pre-bid meetings.

The RFP clarifies that the bidder with the highest annual yield per wagon will be declared successful. Imposing any new criterion or requirement at this stage that restricts a bidder’s participation is thus deemed unjust and discriminatory.

Another firm also wrote a letter, stating: “We are stunned by your decision because it is critical to understand that the tender guarantees annual earnings for PR regardless of whether the wagon is partially or fully loaded (up to the amount specified in the RFP) at the time specified by PR.” Thus, earnings guarantee PR ‘full payments’ even when less volume is loaded on a wagon; any comparison to per tonne or tonne-kilometer rates becomes speculative, arbitrary, and erroneous. “It is extremely unfortunate, illegal, discriminatory, and arbitrary that PR, despite repeatedly stating in the RFP that the criteria for awarding the tender were ‘highest yield per wagon per annum,’ arbitrarily added a new evaluation standard to reject our bid post bid.”

Other firms also filed grievance letters with the committee, alleging that the bidding process violated Public Procurement Regulatory Authority rules.
