Islamabad: The government prohibited all federal institutions from acquiring land for housing purposes on Tuesday, in addition to scrapping all quotas in government housing plans, except for those for its staff.

“The cabinet has determined that no federal government institution will acquire land from residents in Islamabad in the future,” Information Minister Fawad Chaudhry stated during a press briefing following the cabinet meeting.

Meanwhile, Asad Umar tweeted: “Today, the cabinet abolished a decades-old unjust system in which acquired land forcibly from Islamabad residents.” Imran Khan’s government can only make such a populist move.”

However, a senior govt official on condition of anonymity that the government had effectively phased out the Naya Pakistan Housing Program (NPHP) due to the authorities responsible for it, such as FGEHA and NPHA, would not be able to acquire land for providing affordable housing units to the poor.

He added that it would also be unjust for individuals who had already paid for their land through any land award (setting the government price for land). In contrast, others who had not collected it would receive market value for the land.

“Now there is a void: who will determine the market value of land — the seller or the purchaser,” he explained, adding that before this decision, the concerned deputy commissioners had declared the land’s award.

According to Fawad Chaudhry, the prime minister’s discretionary powers to allot plots have been revoked. “The prime minister has not yet exercised that discretionary authority,” he asserted.

The minister stated that the cabinet received a detailed briefing on commodity prices compared to other regional countries and was assured that Pakistan’s prices were the lowest in the region. “Pakistan’s fuel prices continue to be the lowest among non-oil producing countries,” he asserted.

Wheat flour costs Rs60.9 per kilogram in Pakistan, Rs83 in India and Bangladesh, and roughly Rs73 in Afghanistan, according to the ministry.

The minister stated that the price of onion in Pakistan was Rs47.14 per kg, while it was Rs95 in India and Rs121 in Bangladesh. Chicken costs Rs254.92 per kg in Pakistan, while it costs Rs438 and Rs324 in India and Bangladesh, respectively. He stated that petrol costs Rs138.73 per litre in Pakistan, while it costs Rs258 in India and Rs180 in Bangladesh.

IHC prohibits constructions in Margalla Hills National Park

The IHC prohibits Margalla Hills Park. IHC has declared the Margalla Hills National Park off-limits to all building types (MHNP).

The court stated that the chairman of the Capital Development Authority (CDA) and the Islamabad Wildlife Management Board (IWFMB) would be held accountable for any construction in the MHNP.

During the hearing, the lawyer for Monal Restaurant stated that the hotel was built without the approval of the CDA and that they were now being evicted.

He claimed that the Remount Veterinary and Farms Directorate (RVFD) and the CDA were attempting to collect rent.

He stated that they had filed a civil court case opposing their eviction from the location.

Athar Minallah, Chief Justice of the International Human Rights Court, noted that the hotel management signed the lease agreement with an organisation that did not own the site.

“Would you accept if the high court registrar gave you land in a national park?” the court inquired of the petitioner’s attorney.

Nobody has the right to take ownership of state land, the IHC court stated.

He inquired about the directorate’s legal authority to claim custody of state territory or manage any land within a national park.

The chief justice of the IHC stated that the RVFD’s allegation was a breach of the constitution.

The bench stated that it might direct the directorate to submit the rent obtained from the Monal Hotel in the rent and that if the directorate fails to satisfy the court regarding the lease agreement, the trial could begin.

In the judgment, the court stated that the hotel entered into a new deal with the directorate following the expiration of its 15-year lease on August 31, 2021.

Chief Justice Athar Minallah of the IHC stated that the restaurant’s attorney could not convince the court that the contract was legally enforceable.

According to the court, the directorate cannot claim possession of land according to Article 173 or the military land manual, nor can it lease it.

Similarly, the court stated that the CDA was not permitted to lease any land within the national park or permit development.

According to the IHC chairman, a case involving the leasing of the linked property is already pending adjudication, and the Supreme Court has previously declared that no illegal activity or construction is permitted inside the jurisdiction of a national park.

The bench directed the interior secretary, the CDA, and the IWMB to send representatives to the next hearing to clarify the lease arrangement’s authority.

Additionally, the court asked the civic authority and IWMB to notify the court of any illegal projects within the MHNP’s jurisdiction.

CDA lawyer Hafiz Irfan stated that the directorate seeks possession of the hotel’s land and 8,400 acres of Margalla Hills land.

He stated that the CDA granted the restaurant a 15-year lease, but the eatery just began paying rent to the directorate in 2016.

At this point, the hotel’s counsel stated that the decision was made by the federal government and was also approved by the CDA.

AGP asked if the army directorate may acquire, manage national park land. The Islamabad High Court (IHC) sought assistance from the attorney general of Pakistan (AGP) on Friday to determine whether Messers Remount, the General Headquarters (GHQ) veterinary and farms directorate, can legally own or manage state land within the Margalla Hills National Park’s protected area (MHNP).

The instruction responded to an appeal by Messers Monal Group of Companies, which argued that the company had entered into a new lease deal with Remount before the lease agreement with the Capital Development Authority (CDA) expiring on Aug 31, 2021.

The petitioner company owns and operates the Monal Restaurant, a famous dining establishment located within the protected area. The veterinary directorate, Remount, is responsible for breeding and procuring remount animals (horses) to meet the army’s requirements, as well as fodder production, animal holdings, provision of milk and milk products to troops, arrangements for the procurement of green and dry fodder for farm cattle and dry fodder for army animals, as well as breeding beef and mutton animals and supplying them to the armed forces.

According to IHC, the CDA appears incapable of allowing building or granting leasehold rights in a protected area.

The five-page order, authored by IHC Chief Justice Athar Minallah, directed the court office to notify AGP Khalid Jawed Khan to explain the status of the Remount Directorate and whether it is legally permitted to own or manage state land, particularly within the protected area of the national park, as notified under the Islamabad Wildlife (Protection, Preservation, Conservation and Management) Ordinance 1979. (IWPCMO). The case will be reheard on Nov. 9.

Additionally, the court instructed the interior ministry, the CDA, and the Islamabad Wildlife Management Board (IWMB) to nominate top officials to explain why the directorate was permitted to execute a lease agreement within the notified park with what legal authority.

Additionally, the court required the CDA and IWMB to submit reports and notify the court of any illegal building or activity conducted within the national park in violation of the IWPPCMO’s terms.

The court made it clear that if the Remount Directorate fails to convince the court of its jurisdiction to issue leasehold rights within the notified area of the national park, it will explain why the high court cannot require rent deposit before the concerned trial court.

The court expressed regret that the panel of lawyers representing the Monal Group of Companies, namely advocates Saad Hashmi, Sajidur Rehman Mashwani, and Yawar Mukhtar, we’re unable to convince it that the company could have entered into a lease agreement with the Remount Directorate lawfully during the term of the CDA-granted lease.

“It also appears, on the surface, that the Remount Directorate cannot lawfully acquire state property following Article 173 of the constitution as read in conjunction with the Military Lands Manual, nor can it issue leasehold rights.”

According to Article 173 of the constitution, any property purchased for the federation or a province vests in the federal or provincial governments.

“It appears prima facie that the CDA also cannot permit construction or give leasehold rights on any property that is located within the National Park region,” the judgement stated, adding that the property at the centre of the leasing dispute was located within the protected national park’s boundaries.

Additionally, the court highlighted several Supreme Court decisions that stated unequivocally that no illegal activity or construction be permitted within the notified area of the national park.

Additionally, a constitutional petition filed in 2014 challenging the national park’s status and the responsible authorities’ failure to protect it from harm is pending before the high court, the order noted, emphasising that the issues raised for adjudication in the instant appeal and petition were connected to the issues raised in the present case, the resolution of which could have adverse consequences in light of climate change and environmental degradation.

On May 19, 2020, a five-judge Supreme Court bench presided over by Chief Justice of Pakistan Gulzar Ahmed halted the expansion of the Monal Restaurant and directed the CDA to transplant trees that were felled during the development restore the area to its original state.

Firms interested in demolishing the Nasla Tower are required to submit a cost estimate. On Wednesday, the six companies that had submitted proposals for the demolition of Nasla Tower to an eight-member committee were requested to submit their respective demolition costs.

Asif Jan Siddiqui, the committee’s chairman, that the final report on the building’s demolition would be submitted to the commissioner on Friday (tomorrow), since interested firms were required to submit the final cost of demolition on Thursday (today).

He stated that two local firms that formed joint ventures offered to raze the building with controlled implosion blast, and that numerous other local firms expressed interest in mechanical destruction.

According to the DC, two of the organizations had experience mechanically dismantling 12- to 14-story buildings. He stated that no building in the country has been recorded to have been levelled using controlled implosion blast.

Mr Siddiqui stated that the group, comprising of technical specialists, would consider the advantages and disadvantages of the demolition methods given by several companies.

On October 16, the district administration issued vacation notices to inhabitants of Nasla Tower, and on October 26, the Supreme Court ordered the tower’s utility connections to be removed.
