SC reverses land allotment to KMC housing association in Gutter Baghicha. The Supreme Court on Tuesday ordered the revocation of the Karachi Metropolitan Corporation Employees Cooperative Society’s (KMCECS) property allotment after deeming the society’s 200 acres of proprietary rights to be invalid.

A two-judge SC bench led by Chief Justice of Pakistan Gulzar Ahmed also declared the Sindh government’s clearance illegal, directing the Karachi administrator to immediately retrieve the society’s given lands.

The bench had taken up the case of unlawful allotment of amenity plots for commercial and residential purposes in the Gutter Baghicha area.

Karachi’s administrator has been directed to immediately collect 200 acres.

At the court’s most recent hearing on Dec 28, 2021, Shehri’s Amber Alibhai informed the court that the entire acreage of Gutter Baghicha was intended for amenity plots.

On Tuesday, the Supreme Court noted that the approval granted to the society for the allotment of plots was probably issued by a section officer, as the approval letter made no reference to the competent authority certifying the allotment.

According to the statute, such amenity plots could be used solely for educational, religious, or welfare reasons beneficial to the area’s residents, but the cooperative society was neither an individual, an organization, or a government entity, the court noted.

The court stated in its decision that allocating plots to the housing organization did not fall within the scope of welfare reasons.

According to the court, the KMC allocated 200 acres of Gutter Baghicha to its 80 employees.

During the hearing, senior counsel for the society stated before the apex court that the organization housed around 300,000 individuals and cautioned that it should also examine the fundamental rights of widows who would be rendered homeless in the event of an unfavorable court ruling.

Additionally, the lawyer stated that the current action was brought at the direction of individuals responsible for the Lyari gang warefare.

The court made it clear, however, that the SC had to protect the interests and fundamental rights of Karachi residents and also hinted that the court would also hear cases involving the illegal allotment of lands to different societies that were originally owned by the Pakistan Railways and numerous other government departments.

While the court made it clear that the KMC cannot distribute its land directly or indirectly to its employees, it also questioned if the apex court should distribute its land to its employees when it owns parks, lawns, and various plots.

The court noted that the Supreme Court’s land was intended exclusively for the Supreme Court and not for its judges.

Earlier in December, at a hearing in Karachi, the court ordered the authorities to immediately restore Gutter Baghicha and remove any encroachments. “For a city of 30 million people, there should be at least 300,000 parks,” the top justice observed at the time.

This is the same case in which the court had ordered Murtaza Wahab’s dismissal as Karachi’s administrator, stating that Wahab had failed the city’s residents. However, following two public apologies from the administrator, the court reversed its decision and directed Wahab to keep politics separate from his employment.

In 1993, the NGO Shehri filed a petition with the Supreme Court alleging that the KMC society unjustly acquired 200 acres by turning the Gutter Baghicha amenity property to industrial, residential, and commercial usage, thereby destroying the environment.

The FIA is investigating TikTok singer Hareem Shah. The Federal Investigation Agency (FIA) opened a money laundering investigation against TikTok actress Hareem Shah on Wednesday after she claimed to have travelled from Pakistan to the United Kingdom carrying a large sum of cash.

Shah can be seen sitting down with two stacks of British pounds in a video initially published on social media app Snack Video. Upon displaying the money, the social media celebrity stated that this was the first time she had travelled from Pakistan to London with a “big sum.”

According to the website of the Federal Board of Revenue, a traveler may bring any amount of foreign currency into Pakistan, however “taking out foreign currencies is permitted unconditionally up to $10,000.”

Condemning Pakistan’s recent currency decline, Shah added that people feel “sad” when their rupees are converted to euros or dollars.

According to the FIA statement, the investigation into Shah was initiated pursuant to foreign exchange rules, and her “visa, immigration, and travel documentation have been collected.”

“The FIA has launched an investigation and requested information from Pakistan Customs and the Airport Security Force as well “According to the FIA’s spokeswoman.

This is not the first time Shah has been afoul of the law. Authorities initiated an investigation against her in October 2019 after she posted videos of herself in a conference room at the Ministry of Foreign Affairs.

CDWP approves ten Rs96bn upgrading projects of development

On Monday, the Central Development Work­ing Party (CDWP) approved 10 projects worth Rs96.1 billion, which were approved by the group.

The Deputy Chairman of the Planning Commission, Mohammad Jehanzeb Khan, presided over a meeting of the CDWP, which formally approved eight development projects with a total estimated cost of Rs30.2bn. He also recommended two projects worth Rs65.9bn to the Executive Committee of the National Economic Council for approval.

Under the current financial rules, the CDWP can only approve projects that cost less than Rs10 billion. Projects that cost more than that are approved by the Ecnec after the CDWP has approved them on technical grounds.

In general, the CDWP took on a lot of projects in the fields of health and higher education; physical planning; housing and water. Four position papers and one proposal to clear up a concept were also talked about.

They came up with five projects worth a total of Rs25.8bn that the CDWP agreed to. There was a project called ‘Establishing a 200-bed Mother and Child Hospital in District Rajanpur,’ which cost Rs7.48bn. Under the ‘Covid-19 responsive and other natural calamities’ program, the project will be paid for by the Public Sector Development Program. The goal of the project is to make it easier for people in marginalized communities and people who live in a lot of different places to get high-quality maternity and new-born care by providing high-quality health services and meeting the SDG health goals.

Some money will be spent on the “Establishment of the 50-bed Cardiac Hospital at Gilgit-Baltistan (GB)” project, which will cost Rs4.675bn to fund. The project would be paid for by the PSDP. It would provide diagnostic and treatment facilities for the people of GB, as well as the installation of modern biomedical tools like Angiography, Thallium scans, ECGs, ETTs, Echo machines, ICUs, CCUs, and HDUs.

There was also a decision made by the CDWP to buy Mag­netic Resonance Imaging (MRI) equipment worth Rs463.450 million for the Radiology Department of the Pakistan Institute of Medical Sci­ences (PIMS). This will also be paid for by the PSDP. Installing and upgrading MRI and CT (computed tomography) scan equipment in the Radio­logy Department of PIMS is the goal of this project. This is to make sure that the already existing services will continue and that the quality and quantity of the services will get better for the patients who need them most.

The IHC also declared the military’s claim to 8,000 acres of Margalla Hills National Park unconstitutional.

The ruling was issued by IHC Chief Justice Athar Minallah to Islamabad Capital Territory Chief Commissioner Amer Ali Ahmed during a hearing on encroachments in the national park.

“This court will safeguard the public interest as a whole,” the judge stated.

The climate change secretary, who was present at the session, pressed for the release of Islamabad’s master plan.

Justice Minallah stated that all rules pertained to the three branches of the armed forces and inquired as to their implementation. He questioned whether the Pakistan Air Force had obtained consent from the Capital Development Authority (CDA) for the constructions carried out by the Pakistan Air Force.

“It is probable that they are concerned about their security,” he observed.

The judge stated that the defence secretary’s concerns should be heard as well, and the legislation should be strictly enforced. “If the lease of Monal has expired, seal it,” Justice Minallah remarked.

CDA officials responded to the judge’s directions and sealed the restaurant.

The Environmental Protection Agency was instructed to prepare a report on the harm caused by the national park’s construction. Additionally, the IHC directed the CDA to assume control of the Margalla Greens Golf Club today.

“The defence secretary should conduct an investigation into the navy golf course’s encroachments and impose appropriate action against those involved,” Justice Minallah stated.

The IHC directed the defence secretary to oversee compliance with the court’s instructions and to ensure that none of the armed services’ three branches engaged in illegal construction.

“The defence secretary and chief commissioner should ensure that no complaints are brought before the court at this time,” Justice Minallah stated.

On November 9, the IHC held many officials accountable for their complacency about the devastation of Margalla Hills National Park and the wildlife sanctuary. Additionally, the court ordered a survey of the damage and the submission of a report.

Earlier that month, the court had also asked Pakistan’s attorney general to explain whether Messers Remount, the General Headquarters’ (GHQ) veterinary and agriculture department, could lawfully possess or manage state land within the national park’s designated region.

‘Armed forces should not be a source of contention.’
The court was notified at the start of the hearing by the additional attorney general (AAG) that Special Assistant to the Prime Minister on Climate Change Malik Amin Aslam would be unable to appear due to a positive Covid-19 test.

Justice Minallah questioned the climate change secretary about his job description, noting that “the ministry has admitted that the state’s land has been encroached upon by private individuals.”

“How should this court proceed?” “What is occurring is unexpected,” the court stated.

Justice Minallah observed that “lawlessness” pervades the capital territory’s 1400 square miles.

“Three armed forces [wings] have been established into sectors (army, military, and navy). Armed forces should be completely uncontroversial. “It is not in the public interest,” said the court.

He stated that the law was clear on who may manage the armed forces’ lands and how they might do so, adding that the court would not allow anyone to politicize the armed forces. IHC closes the Monal Restaurant and targets military incursions into the national park

“A national park area is a protected area that cannot be used for any purpose. Nobody is permitted to cut grass within the national park region,” the court stated.

At this moment, Justice Minallah questioned where a land with no use or purpose could go. The AAG responded that it was the administration’s responsibility to determine this, to which the court said, “This is a matter for the law, not the executive.”

“No institution may own property,” the judge stated. “This court is tasked with the responsibility of safeguarding the national park. “The 8,000 acres of land have been added to the national park,” he noted.

Justice Minallah remarked that the armed forces were not autonomous, but rather were under to the Ministry of Defence’s direction.

The top justice stated that the navy’s construction of a golf course on encroached territory was not a “positive thing.” “Every citizen has a healthy regard for the military forces. If they do this (invade state property), it will convey the wrong message,” Justice Minallah observed.

“First and foremost, we must hold ourselves accountable. The poor are impoverished as a result of lawlessness.

“You admitted yourself that the golf course was illegal,” the judge stated before ordering the military secretary to turn over the golf course’s land to the CDA.

Meanwhile, CDA Chairman Amer Ali Ahmed informed the court that the navy had received a warning to close its sailing club.

The IHC ruled on Friday that the navy’s sailing club and farmhouses built on national park territory were illegal and ordered their demolition.

The defence secretary then informed the court that communities and hamlets were encroaching on park property as well.

The CDA chairman stated that alterations to the city’s master plan were being made without consideration and that “every institution has encroached in some way.”

He stated that the subject would also be brought to the cabinet’s attention.
